AMLD 5 (anti-Money Laundering)
The AMLD 5 (Anti-Money Laundering Directive) legislation stipulates that once one or more transactions exceed a total amount of €10,000, sellers of artworks must comply with the Know Your Customer (KYC) principle. This means that art dealers are required to obtain additional information about the buyer.
- If the buyer is a private individual, a copy of their identity card and proof of residence are required.
- If the buyer is a company, the following documents are required: a copy of the identity card and proof of residence of one of the directors; proof of the registered office address; and the names and dates of birth of all directors and the UBOs (ultimate beneficial owners).
